1. Acceptance of Terms
By accessing or using the website and services provided by American Chemical Analytics LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to all of the terms and conditions, you must not use our services.
2. Service Description and Limitations
American Chemical Analytics LLC provides mail-in water testing kits for residential use. Disclaimer: While our partner lab uses EPA-standard methodologies and is ISO/IEC 17025 accredited, our services are intended for informational screening purposes only. Unless explicitly stated otherwise in a separate written agreement involving third-party chain-of-custody collection, our results may not be legally admissible for real estate transactions, litigation, or regulatory compliance.
3. Governing Law and Jurisdiction
These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Disputes arising from transactions or data collection will be handled under Florida jurisdiction.
Physical laboratory processing of samples is performed by ETR Laboratories in Leominster, Massachusetts, and operations physically occurring within that facility are subject to the laws and environmental regulations of the Commonwealth of Massachusetts.
4. Payment and Third-Party Processor
All payments are processed securely through Stripe. By purchasing from us, you agree to Stripe's Terms of Service. American Chemical Analytics LLC does not store your credit card information. Prices are subject to change without notice.
5. Refund and Return Policy
If a testing kit arrives damaged, you must notify us within 30 days of receipt to qualify for a free replacement. Due to the strict chain-of-custody requirements for environmental testing, unused kits that have been shipped to a customer cannot be returned for a refund under any circumstances.
6. Strict Confidentiality
As detailed in our Privacy Policy, we operate under a strict confidentiality model. We will not share your test results with any agency, neighbor, or third-party entity unless explicitly requested by you or required by a valid legal subpoena.
